Homeowners and Renters Insurance
Many people are not aware of the fact that their homeowners insurance policy not only provides them with insurance coverage for damage to their home, but also provides them with liability coverage for certain acts of negligence occurring both on and away from their premises. The liability coverage provided by a homeowners insurance policy is limited and depends on the language of the policy. However, all homeowners policies will have exclusions for any accident that arises out of the operation and use of a registered motor vehicle.
Where most individuals require the assistance of an attorney with regard to a homeowners insurance policy is in a personal injury case such as a premises liability case or a dog bite case. The second area where an attorney is often required is in the situation where the homeowner’s own insurance company denies a claim for damage to the premises. These are often claims for water damage, storm damage, foundation damage or fire damage which have either been denied or the insurance company has offered significantly less than is reasonable for the loss suffered. For more information on your rights, the Texas Insurance Commission has prepared a Consumer Bill of Rights for Homeowners, Dwelling and Renters Insurance.
Mr. Bemis is Board Certified in Consumer and Commercial Law to handle such claims.
