Americans With Disabilities Act (ADA)

Federal law prohibits discrimination against qualified individuals with disabilities.  In order to be a qualified individual with a disability, you must be an individual with a disability who, with or without reasonable accommodation, can perform the essential functions of the employment position that such individual holds or desires

The term reasonable accommodation may include making existing facilities used by employees readily accessible to and usable by individuals with disabilities; and job restructuring, part-time or modified work schedules, reassignment to a vacant position, acquisition or modification of equipment or devices, appropriate adjustment or modifications of examinations, training materials or policies, the provision of qualified readers or interpreters, and other similar accommodations for individuals with disabilities.

Like other federal discrimination laws, the employer must have at least 15 or more employees for each working day in each of 20 or more calendar weeks in the current or preceding calendar year.  Additionally, the charge of discrimination must be filed with the EEOC within 300 days of the discriminatory conduct.
